RAPID CITY, S.D. (KOTA) – Initiated Measures 28 & 29 have been two of the more discussed items on South Dakota’s ballot this election cycle. If passed, IM 28 would prohibit sales taxes on goods sold for human consumption and IM 29 would legalize recreational marijuana in South Dakota.
If these measures pass, South Dakota Attorney General Marty Jackley may be tasked with clarifying legal language before they go into effect July 1, 2025. He says this may be necessary for IM 28.
The measure itself did not define ‘for human consumption,’” Jackley explained. “So, either the the legislature will need to, or I, as attorney general in an attorney general opinion will have to, or possibly the courts. I would use a common sense, broad definition. I mean, human consumption, to me, is anything you put in the body.”
